Instructing TU Simple

By entering into the Agreement, you hereby warrant that you have the necessary authority, power and capacity to do so and that you are either the beneficial owner of the Property or have the authority from the beneficial owner to sell the Property on these terms. You also warrant that you are not acting in a professional capacity as a property developer, an estate agent or on behalf (whether as an employee, agent or otherwise) of an estate agency.

Sole Agent

TU Simple will be the sole agent (‘sole agents’ means that you have instructed us a as the only estate agent for the Period to sell the Property subject to the payment of the Fees and ‘sole agency’ shall be interpreted accordingly) for the sale of the Property upon the terms of this agreement commencing from the date when we have both signed this agreement, subject to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (‘the Regulations’), until it is ended in accordance with clause Ending the Agreement. This Agreement gives us the right to act as sole agent in relation to the Property for an initial period of 12 weeks and then until other agreed (‘the period’).

Right to Cancel

THE CONSUMER CONTRACTS (INFORMATION, CANCELLATION, AND ADDITIONAL CHARGES) REGULATIONS 2013: The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (‘Regulations’) apply to this matter. The Regulations give you the right to cancel your instructions without the need to give any reason.

The cancellation period will expire after 14 days from the day you receive this agreement. To cancel your instructions within the 14 day period you must notify us at 3 Coldyhill Lane, Scarborough, YO12 6SF of your decision to cancel instructions by a clear statement and preferably in writing.

If you cancel your instructions within the 14 day period, we will reimburse you your fixed fee without undue delay, and not later than 14 days after the date on which we receive the notice of your decision to cancel your instructions.

Ending the Agreement

Subject to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, either party may end this Agreement on or after the Period by giving 14 days written notice (for termination at the end of the Period, written notice must be given at least 14 days prior to the end of the Period). Any Fees paid are non-refundable within the Period or thereafter.


The fixed fee of £897, inclusive of VAT, will be paid once you agree to these Terms and Conditions and prior to any photographs being taken and your Property being advertised online. Payment can be made via debit/credit card

The upfront Fee is non-refundable except where you have cancelled this Agreement in accordance with the clause ‘Right to Cancel’.

Payment Details

When you instruct TU Simple to market your Property, we may take certain information from you, such as full debit/credit card details. By providing this information, you are authorising TU Simple to take any due payments. This information will be used to take the payment of £897 via Worldpay and will NOT be stored on our system. Billing will occur at the time of, or shortly after your transaction. For Sale Board

Once you have instructed TU Simple and paid the fixed fee, we will erect a For Sale board at your Property. Your For Sale board belongs to TU Simple, however the maintenance of the For Sale board is your responsibility whilst it is at your Property. You are required to keep the For Sale board safe and secure and to preserve the board for collection once your Property is sold or is withdrawn from the market.


You understand that you are responsible for all viewings at your Property, whether it is occupied or vacant. Viewings will be arranged via your online property portal where you can select your availability and potential purchasers will book a slot within this specified time. You will receive an email with confirmation of the viewing. If you can no longer accommodate the viewing, you have the option to cancel the viewing.


Offers can be made directly to you via the TU Simple website. If any offers are made via the TU Simple telephone number, we will report the offer to you immediately. Once you have accepted an offer, we will qualify the potential purchaser to ensure they are in a position to proceed, before marking your property as sold subject to contract.

Asking Price

The asking price does not represent a valuation, it is a recommended asking price based on our knowledge of previous sales and the prevailing level of asking prices in the area. The sale price achieved will depend on the number of potential buyers in the market place, the level of similar properties available during the marketing process and general marketing conditions. Other factors such as the speed if the sale required, the buyer’s survey or the lenders valuation may also affect the eventual sale price. Property particulars will be promoted on the TU Simple website and other websites affiliated with TU Simple, eg. Rightmove, Zoopla, PrimeLocation.

Property Description

It is an offence under the Consumer Protection from Unfair Trading Regulations for us (or any other estate agent) to misdescribe the Property. You have the responsibility to us to ensure that all factual information you provide to us about the Property is correct and true to the best of your knowledge, information and belief.

Personal Interest

Estate Agents Act 1979: To avoid conflict of interest, the Act requires that We are transparent with our customers about you and any person related or connected to You, who work for, or has a business relationship with TU Simple.
